PRELIMINARY INFORMATION

1. Introduction

This document (together with all other documents mentioned below) sets out the terms and conditions regarding the use of the website and the purchase of products through this website (hereinafter referred to as the "Terms"). Before using the website, the Customer should read the Terms, our Cookie Policy, and our Privacy Policy (collectively referred to as the "Data Privacy Policy"). By using this website or placing an order through the website, you, our valued Customer, explicitly consent to being subject to these Terms and the Data Privacy Policy and agree, declare, and undertake to comply with them. If the Customer does not accept all the Terms and the Data Privacy Policy, they should not use the website. These Terms and the Data Privacy Policy may be amended. It is the Customer's responsibility to read them regularly, and the Terms and Data Privacy Policy in force at the time the Customer uses the website or enters into the Agreement (as explained below) will be applicable to the Customer.

2. Information on the Website and Your Visits

To purchase a desired product, the Customer must share their personal information. The information or personal data shared with hamfabrics.com is processed in accordance with the Data Privacy Policy. By using the website, the Customer confirms that all the information they provide to hamfabrics.com is correct and true and is deemed to have accepted the processing of this information and personal data. If the Customer explicitly states their interest to hamfabrics.com, hamfabrics.com may inform them via email about the latest collections, catalogs, campaigns, and special offers.

3. Use of the Website

By using the website and/or placing an order through the website, the Customer agrees, declares, and undertakes to:

1. Use the website only for legitimate requests or orders,
2. Not place unrealistic, false, or fraudulent orders; if hamfabrics.com has reasonable grounds to believe that such an order has been placed, it reserves the right to cancel the order and notify the relevant authorities,
3. Provide hamfabrics.com with accurate and up-to-date email, postal, and/or other contact information, and acknowledges that hamfabrics.com may use this information to contact the Customer if necessary (see Data Privacy Policy).

If the Customer does not provide all the necessary information for order completion, hamfabrics.com may not complete the order. By placing an order through the website, the Customer confirms that they are at least 18 years old and legally capable of entering into contracts.

4. Availability of Services

The products available on this website are only suitable for delivery within the borders of the Republic of Turkey.

5. Formation of the Contract

To place an order, the Customer must follow the online purchase process and click the "Confirm Payment" option. After doing so, the Customer will receive an email acknowledging receipt of the order ("Order Confirmation"). A second email will be sent to the Customer later, notifying them that the order has been accepted and is being dispatched ("Delivery Confirmation"). If no such confirmation is provided by hamfabrics.com, the Contract will not be deemed to have been formed.

6. Product Availability

All orders are subject to stock availability. In case of supply difficulties or if a product is out of stock, hamfabrics.com reserves the right to inform the Customer about alternative products of similar or different categories and values. If the Customer does not wish to order substitute products, hamfabrics.com will refund the amount paid for the unwanted substitute product.

7. Rejection of Orders

hamfabrics.com reserves the right to withdraw any product from the website and/or remove or edit any material or content on the website at any time. Although hamfabrics.com will make all reasonable efforts to process all orders received, it reserves the right to refuse or reject an order under exceptional circumstances, even after sending an Order Confirmation. hamfabrics.com is not liable to the Customer or any third party for withdrawing any product from the website, removing or editing any material or content, or refusing to fulfill an order after an Order Confirmation has been sent.

8. Delivery

Subject to stock availability (see Clause 6) and in the absence of exceptional circumstances, hamfabrics.com will deliver orders listed in the Delivery Confirmation by the delivery date specified in the confirmation. If no estimated delivery date is provided, hamfabrics.com will deliver the order within a maximum of thirty (30) days from the Order Confirmation date. If delivery is delayed due to circumstances beyond hamfabrics.com's control, the Customer will be notified as soon as possible, and measures will be taken to minimize the delay.

9. Failure to Deliver

If delivery is not possible, the products will be returned to the warehouse. The Customer will be informed about the whereabouts of the order and how to reschedule the delivery. If the Customer is not available at the delivery location at the agreed time, they should contact hamfabrics.com to arrange an alternative delivery date. If the Customer does not contact hamfabrics.com within fifteen (15) days of the failed delivery, the Contract may be terminated. In such a case, hamfabrics.com will refund the amount paid by the Customer within fourteen (14) days, excluding any additional shipping costs arising from a non-standard delivery method requested by the Customer.

10. Risk and Ownership

The responsibility for the products remains with hamfabrics.com until they are delivered to the Customer or the person at the delivery address. Ownership of the products is transferred to the Customer once they or a designated person take delivery.

11. Price and Payment

The price of the products is as stated on the website. hamfabrics.com ensures that all prices on the website are accurate, but errors may occur. If a pricing error is identified after an order is placed, the Customer will be informed and given the option to confirm the order at the correct price or cancel it. If hamfabrics.com cannot contact the Customer, the order will be canceled, and the amount paid will be refunded.

All prices include VAT and other applicable taxes but exclude delivery fees. The total order price, including any additional charges, will be shown during checkout. Payments can be made using the available payment methods listed on the website. The order will only be processed upon successful authorization of payment.

15. Return Policy

15.1. Legal Right of Withdrawal

Customers have the right to withdraw from the contract within fourteen (14) days of receiving the product without providing any reason (except for products listed under Clause 15.2).

The withdrawal period expires fourteen (14) days after the Customer or a third party (other than the courier) takes possession of the product. To exercise the right of withdrawal, the Customer must notify hamfabrics.com in writing via email at [email protected] or by sending a written notice to Çankaya Mah. Nilgün Sok. 7/11 Çankaya, Ankara, Turkey.

Upon withdrawal, the Customer must return the product within ten (10) days from the date of withdrawal notification. Refunds will be issued within fourteen (14) days of receiving the withdrawal notification, using the same payment method used for the original transaction.

Exceptions to the Right of Withdrawal:

1. Products made to the Customer’s specifications or clearly personalized.
2. Sealed goods that cannot be returned once opened due to hygiene or health protection reasons.
