Privacy and Security Agreement | Hamfabrics
Dear Customers, Members, and Valued Friends Benefiting from Our Products and Services as a Company,
As Selin Çalışkan Ergenç Sole Proprietorship (“Ham Fabrics”), we place great importance on the protection of your personal information in accordance with the Law on Protection of Personal Data No. 6698 ("KVKK"). Acknowledging this responsibility, we would like to inform you about your rights regulated under the Personal Data Protection Law.
1. WHAT IS THE PERSONAL DATA PROTECTION LAW?
The Law on Protection of Personal Data No. 6698 ("KVKK") was adopted by the Turkish Grand National Assembly on March 24, 2016, and entered into force after being published in the Official Gazette on April 7, 2016.
At Ham Fabrics and our website, www.hamfabrics.com, the privacy, protection, processing, and usage of member-customer information, as well as commercial electronic communications and other matters, are governed by the Privacy and Security terms outlined below.
During our activities, we are considered a Data Controller regarding the personal information we collect from you. As the Data Controller, we may record, store, update, classify, disclose to third parties and/or transfer abroad, and process your personal data in other ways as specified in KVKK within the scope of legal permissions.
2. PURPOSES AND LEGAL REASONS FOR PROCESSING PERSONAL DATA
The purposes and legal reasons for processing personal data include:
- Preparing all necessary records and documents in electronic or paper form,
- Complying with the information retention, reporting, and disclosure obligations stipulated by legislation and relevant authorities,
- Providing the requested products and services and fulfilling contractual obligations,
- Identifying the identity information of individuals making purchases via the website/mobile applications,
- Recording address and other necessary details for communication purposes,
- Contacting customers regarding contract terms, current status, and updates under the Distance Sales Agreement and Consumer Protection Law,
- Arranging all records and documents necessary for processing transactions in electronic or paper format,
- Fulfilling obligations under the Distance Sales Agreement and Consumer Protection Law,
- Providing information to public officials upon request and as required by legislation concerning public security,
- Improving the shopping experience of our customers, providing relevant product recommendations, and informing customers about campaigns,
- Enhancing customer satisfaction, recognizing customers who shop via the website and/or mobile applications, and analyzing customer demographics for marketing and advertising purposes,
- Offering suggestions to customers through our business partners and solution partners,
- Evaluating customer complaints and suggestions regarding our services,
- Fulfilling legal obligations and exercising our rights under applicable legislation.
These personal data are under the supervision and control of Ham Fabrics and www.hamfabrics.com.
We undertake the responsibility of taking and adapting technical and organizational measures to protect the confidentiality and integrity of this information in compliance with applicable legislation. Aware of this responsibility, we conduct periodic penetration tests in line with international and national technical standards related to data privacy and continuously update our data processing policies.
3. IS YOUR PERSONAL DATA SHARED?
The sharing of customers' personal data with third parties occurs within the scope of customer consent, and as a rule, personal data is not transferred to third parties without the customer's approval.
However, personal data is shared with courts and other public institutions in cases where we are legally obligated to do so. Additionally, personal data is shared with third parties to whom we are contractually bound to provide services or conduct quality control. Necessary technical and legal precautions are taken to prevent rights violations during data transfers to third parties.
4. WHAT ARE YOUR RIGHTS UNDER THE PERSONAL DATA PROTECTION LAW?
Under KVKK, you have the right to:
a) Learn whether your personal data has been processed,
b) Request information if your personal data has been processed,
c) Learn the purpose of processing your data and whether it is used in accordance with its purpose,
d) Know the third parties to whom your personal data is transferred domestically or abroad,
e) Request correction if your data has been processed incompletely or inaccurately,
f) Request the deletion or destruction of your personal data under the conditions set forth in Article 7 of KVKK,
g) Request notification of the transactions made under (d) and (e) to third parties to whom your data has been transferred,
h) Object to the emergence of a result against you by analyzing your processed data exclusively through automated systems,
i) Demand compensation if you suffer damage due to unlawful processing of your personal data.
5. HOW LONG DO WE RETAIN YOUR PERSONAL DATA?
Even if your personal data has been processed in compliance with the relevant laws, if the reasons for processing are no longer valid, your personal data will be deleted, destroyed, or anonymized upon request or by our company.
However, under the Law on the Regulation of Electronic Commerce No. 6563, records of consent withdrawal must be retained for 1 year from the withdrawal date. Additionally, records of the commercial electronic message's content and all relevant logs must be stored for 3 years to be provided to the relevant Ministry when necessary. Once this period expires, your personal data will be deleted, destroyed, or anonymized upon request or by our company.
