DISTANCE SALES AGREEMENT | HAMFABRICS
1. PARTIES
This Agreement has been executed between the following parties under the terms and conditions specified below.
A. ‘BUYER’; (hereinafter referred to as "BUYER" in the contract)
B. ‘SELLER’; (hereinafter referred to as "WWW.HAMFABRICS.COM" in the contract)

By accepting this agreement, the BUYER acknowledges that upon confirming the order, they are obligated to pay the total order amount, including shipping fees, taxes, and any other additional charges if applicable.
2. DEFINITIONS
For the purposes of this agreement, the following terms shall have the meanings ascribed to them:
- MINISTER: Minister of Customs and Trade,
- MINISTRY: Ministry of Customs and Trade,
- LAW: Law No. 6502 on Consumer Protection,
- REGULATION: Distance Contracts Regulation (Official Gazette: 27.11.2014/29188),
- SERVICE: Any consumer transaction other than supplying goods, performed in exchange for a fee or benefit,
- WWW.HAMFABRICS.COM: The company offering goods or services to consumers within the scope of commercial or professional activities,
- BUYER: The real or legal person acquiring, using, or benefiting from a good or service for non-commercial or non-professional purposes,
- SITE: The website belonging to WWW.HAMFABRICS.COM,
- ORDER PLACER: The real or legal person requesting goods or services through the website,
- PARTIES: WWW.HAMFABRICS.COM and the BUYER,
- AGREEMENT: This contract between WWW.HAMFABRICS.COM and the BUYER,
- GOODS: The movable goods subject to shopping, as well as software, sound, images, and similar intangible goods prepared for use in an electronic environment.
3. SUBJECT
This Agreement regulates the rights and obligations of the parties concerning the sale and delivery of the product(s) specified below, which the BUYER has ordered electronically via the website belonging to WWW.HAMFABRICS.COM, in accordance with Law No. 6502 on Consumer Protection and the provisions of the Distance Contracts Regulation.
The prices listed and announced on the website are the selling prices. The prices and commitments remain valid until updated or changed. Temporarily announced prices are valid until the expiration of the specified period.

6. PRODUCT(S) SUBJECT TO THE CONTRACT
6.1. The basic features of the product(s)/service(s) (type, quantity, brand/model, color, quantity) are available on the website of WWW.HAMFABRICS.COM. If a campaign is organized by WWW.HAMFABRICS.COM, the essential features of the relevant product can be reviewed during the campaign period. The campaign is valid until the specified date.
6.2. The listed and announced prices are the sales prices. These prices remain valid until updated or changed. Temporarily announced prices are valid until the end of the specified period.

6.4. The shipping cost for the product shipment shall be borne by the BUYER.

8. SECURITY, PRIVACY, PERSONAL DATA, ELECTRONIC COMMUNICATIONS, AND INTELLECTUAL PROPERTY RIGHTS
8.1. Necessary measures have been taken within the system infrastructure of WWW.HAMFABRICS.COM to ensure the security of the information and transactions entered by the BUYER on the WEBSITE.
8.2. In addition to the consent and confirmation given by the BUYER regarding personal data and commercial electronic communications, the information obtained during the BUYER’s membership and purchases on the WEBSITE may be recorded indefinitely or for a determined period by WWW.HAMFABRICS.COM.
8.3. The BUYER can always contact WWW.HAMFABRICS.COM through the specified communication channels to stop the use and processing of their data and/or to stop electronic communications.
8.4. All intellectual and industrial property rights and ownership rights related to the WEBSITE, except for those belonging to third parties as per an agreement, belong to WWW.HAMFABRICS.COM.
9. GENERAL TERMS
9.1. The BUYER confirms that they have read and accepted the pre-contractual information regarding the product, sales price, payment method, and delivery, as well as the necessary confirmation in an electronic environment.
9.2. Each product shall be delivered to the BUYER or a designated person within 30 days, unless stated otherwise on the website. If the delivery cannot be made within this period, the BUYER has the right to terminate the contract.
10. RIGHT OF WITHDRAWAL
10.1. The BUYER has the right to withdraw from the contract within 14 days of receiving the product without any legal or penal liability, provided that they notify WWW.HAMFABRICS.COM.
10.2. In order to use the right of withdrawal, a written notification must be sent to WWW.HAMFABRICS.COM via registered mail, fax, or email within 14 days.
11. PRODUCTS THAT CANNOT BE RETURNED
Products that are prepared according to the consumer’s personal preferences, intimate wear, swimwear, cosmetics, perishables, digital content, and software cannot be returned once the packaging is opened.
12. DEFAULT AND LEGAL CONSEQUENCES
If the BUYER defaults on payments made by credit card, they acknowledge and accept that they will pay interest in accordance with the credit card agreement and be liable to the bank.
13. COMPETENT COURT
In case of disputes arising from this agreement, complaints and objections can be made to the Consumer Arbitration Committee or Consumer Court where the BUYER resides.
14. ENFORCEMENT
By making a payment for the order, the BUYER is deemed to have accepted all terms of this agreement.
